Object These general conditions regulate the contractual relationship between Wijngoed and Zorghoeve de Reestlandhoeve v.o.f. hereinafter referred to as de Reestlandhoeve, with place of business, Hoofdweg 21 7707 RB Balkbrug, registered under KVK nr 69759669 having as its main activity the cultivation and sale of wines and offering day care. Any situation not provided for by our general or special conditions, is governed by the generally applicable legal regulations. Ordering Orders via the website of the Reestlandhoeve or in the Wine Shop of the Reestlandhoeve always take place under acceptance of the general terms and conditions. The Reestlandhoeve has the right not to process inaccurate or incomplete order forms. Alcohol & responsibility We do not sell alcohol to persons under the age of 18. With your (online) order, you hereby declare that you are responsible for your purchase and are over 18 years of age. Your age may be verified by the courier delivering the wines or verified at the Wine Shop. Contract Party We only sell to: a. natural persons over 18 years of age b. legal entities. When accepting these terms and conditions, the customer declares that he/she is over 18 years of age. Deliveries Deliveries are made according to the costs and delivery times stated on the webshop upon receipt of a complete and correct order and payment, unless otherwise stated in the offer for sale or on the order confirmation. The customer is always obliged to check the number of packages received before signing the delivery/freight note. Once signed, this is no longer subject to discussion. The Reestlandhoeve is not liable for damages resulting from exceeding delivery times. When your order is not in stock, you will be contacted about the delivery time. If the delivery time is not acceptable to you, the order will automatically be canceled. Deliveries outside the Netherlands Higher shipping costs will be charged for a delivery outside the Netherlands. It is also possible that additional import duties or excise taxes have to be paid. Prices The prices and rates are always expressed in Euro and are per bottle or per box, as per the indication on website and in the Wine Shop at the time of ordering or while stocks last. The content of the bottle is indicated in the product description or on the back label. On the website and in the Wine Shop all prices include VAT (21%) and packaging tax. Wijngoed de Reestlandhoeve has the right to change prices and to correct any typographical errors. If you would be disadvantaged by this, you will be informed by e-mail. You then have the right to cancel your order. In addition, the Reestlandhoeve can change prices if these price changes are due to objective circumstances (VAT, taxes on goods, packaging materials, transport, …). All offers of the Reestlandhoeve are without obligation. Offers are made subject to availability of the wine. When a product is unexpectedly no longer available, you will be contacted and possibly offered an alternative. You then have the right to cancel your order. Your shopping cart will be held for you for 30 minutes. Personalized orders Orders that are personalized (read personalized labels, personalized gift boxes, as well as gift certificates and gift packages with a personal message) cannot be returned. Payments Invoices must be paid before shipment to a bank account number provided by the Reestlandhoeve or via the online payment system. In case of partial delivery, the customer undertakes to pay for what has already been delivered in accordance with the pricing on the invoice. Complaints regarding the invoice must be reported to the Reestlandhoeve by e-mail and within 14 days after invoice date. Only after payment will be proceeded to delivery. If an invoice is not paid after 14 days after invoice date, you will receive a reminder, maximum 3, after which we will proceed to collection. A collection always receives a surcharge (read interest rate) on the outstanding amount. This should also be paid after receiving the collection. If a bailiff has to be called in, these costs are passed on to the customer. The collection process starts 46 days after the due date of the invoice. If one or more invoices are not or too late paid as well as in case of bankruptcy, administration, collective debt settlement and any other indication of apparent insolvency or incompetence, the Reestlandhoeve reserves the right to refuse orders, it can also suspend a current order as long as invoices are not or not fully paid, without the Reestlandhoeve is or can be held to any compensation. The amounts of our invoices are payable in cash, net without discount. Retention of title All items delivered by Wijngoed en Zorghoeve de Reestlandhoeve v.o.f. remain the property of Wijngoed en Zorghoeve de Reestlandhoeve v.o.f. until the moment that the buyer has fully satisfied all his payment obligations to Wijngoed en Zorghoeve de Reestlandhoeve v.o.f. by virtue of any agreement concluded with Wijngoed en Zorghoeve de Reestlandhoeve v.o.f. for the delivery of goods or the performance of work or services, claims in respect of failure to perform such agreement included. Force majeure The Reestlandhoeve is never liable for situations of force majeure or any other cause beyond its control (war, strike, lockout, breakage, theft, fire, logistical problems at transporters and third parties, etc.) which could lead to the Reestlandhoeve not being able to meet its obligations or not being able to meet them on time, although it will always try to do its utmost to execute the agreement with delay, if necessary, without being or being able to be held liable for compensation. Applicable law and jurisdiction All our agreements, including the special and general contract and invoice conditions, as well as their execution, are subject to Dutch law. The nullity of one or more parts of these terms and conditions shall in no case result in the nullity of the entire agreement but only in the nullity of the celebrated part. The other provisions will therefore remain fully and unaffected by this. In case of any dispute, Dutch law applies. Dissatisfied If you are dissatisfied with the wines you ordered, we are willing to find a solution. Opened bottles cannot be returned. However, you can exchange closed bottles for other Reestlander wines up to 14 days after purchase. No money back will be given for the wines you ordered. Any shipping costs are for your own account.

This is because the gift certificate (code) will be sent once to the email address you specify for it. The validity of the gift certificate is 3 years from the date of issue. A gift certificate can be redeemed via the Reservation Widget or directly at the Reestlandhoeve. Before the gift certificate can be redeemed via the Widget, an available date and time must be selected. If the desired time is not available, you will have to choose another time. Right of Withdrawal The legal right of withdrawal for consumers does not apply to the purchase of gift certificates. Reservations Reservations are placed directly with the Reestlandhoeve. If you place a reservation it is valid for the number of persons, date and time for which the reservation is placed. If the reservation relates to a particular package, then its description is included in the Widget. We assume that the reservation will go through without contrary notice. Reservations are in principle final. Change or cancellation of a reservation is possible as soon as this is stated in the Widget or if this possibility is still offered. For refunds of deposits, see the heading ‘payments’ below. It is important that all persons show up at the reserved time. If all persons are not present within thirty minutes from the reserved time, the Reestlandhoeve may still decide to cancel the reservation without any obligation to refund. The Reestlandhoeve makes every effort to have the reserved table available at the reserved time, however, it is possible that something runs out and that you therefore have to wait a while. The Reestlandhoeve reserves the right to refuse a placed reservation if it has good reasons to do so. In that case, you will be timely informed. Any prepaid amounts will then be refunded as soon as possible. Down payments In the Widget or in the submitted offer it is always clearly stated under which conditions a (down) payment is made, whether cancellation and refund is possible and until when. Should a refund be required, the Reestlandhoeve will refund the relevant amount as soon as possible via the payment method you used. No-show The Reestlandhoeve has a strict no-show policy and does not issue refunds when guests do not appear during the reservation. Custom Group Arrangements When you visit the Reestlandhoeve with a group, you can either make a reservation through the Widget on the website or book a group arrangement by email. On group arrangements, the following cancellation conditions apply: At least 2 weeks in advance the Reestlandhoeve receives the final number of guests so that we and any partners have sufficient time to purchase and prepare everything. Should there ultimately be fewer people come then we use the following scheme per person who comes less (at least 35 people will be charged) (this cancellation scheme corresponds to the uniform conditions catering Netherlands): Payable per person not in attendance: More than 14 days before reserved time 0% 14 days or less but more than 7 days before reserved time 25% 7 days or less before reserved time 50% 3 days or less before reserved time 75% Invoice payments When no deposit is made via the Widget on the website and a group arrangement is booked by e-mail or in consultation with the Reestlandhoeve you will receive an electronic invoice afterwards. The customer undertakes to pay the invoice when the visit to the Reestlandhoeve has ended. Complaints regarding the invoice must be reported to the Reestlandhoeve by e-mail and within 14 days after invoice date. The invoice is always in accordance with the offer. If an invoice after 14 days after invoice date is not paid you will receive a reminder, up to 3, then proceed to collection. A collection always receives a surcharge (read interest rate) on the outstanding amount. This should also be paid after receiving the collection. If a bailiff has to be called in, these costs are passed on to the customer. The collection process starts 46 days after the due date of the invoice. If one or more invoices are not or too late paid as well as in case of bankruptcy, administration, collective debt settlement and any other indication of apparent incapacity or incompetence, the Reestlandhoeve reserves the right to collect the payment, without the Reestlandhoeve being or could be bound to any compensation. Special events At special events it is possible to stock Reestlander wine. It will be administered in advance which wines and how many wines will be present at the event. If there is wine left over, the wine may be returned provided there are unbroken boxes. Poured wines and broken boxes will be charged afterwards. The wines will be picked up and returned by the person or organization of the event within one week after the event. If the wines are not returned everything will be charged. The person or organization of the event is responsible for the storage conditions of the wine. Wine stored too warm (>+ 20 C) or too cold (<+ 4 C) and damaged as a result will be charged. This also applies to bottles and boxes with a damaged appearance. The Reestlandhoeve reserves the right to check the storage conditions of the wine during the event. Terms and Conditions Vines Lease Certificate With a Vines Lease Certificate from the Reestlandhoeve, you are the owner of a number of vines from the winery for one year. You will receive 12, 18 or 24 bottles of Reestlander wine from the new harvest. After payment of the Vines lease certificate, your registration is final and the Vines lease certificate is valid. With this certificate you can identify yourself at the Reestlandhoeve and make use of the various benefits. If a Vine lease certificate has been purchased by invoice, the Reestlandhoeve reserves the right to cancel the Vine lease certificate if payment is not made. Should it happen that there is a mis-harvest or an inferior harvest this will be communicated to you and restrictions may be in effect on the picking of the Reestlander wines. It may also happen that the delivery of the Reestlander wine is (partially) delayed. Ultimately, you will receive the number of bottles of wine for which you entered into a Vine Lease Certificate. The legal right of withdrawal for consumers does not apply to the purchase of a Vine lease certificate. Wijngoed de Reestlandhoeve does its utmost to make a good quality wine. However, the taste of the Reestlander wines may vary from year to year. This depends on the season and weather conditions. Vines lease certificate holder and member of our Wine Club mean the same thing within the Reestlandhoeve. Benefits The Vines lease certificate offers you several advantages:
- 12 (Bronze), 18 (Silver) or 24 (Gold) bottles of Reestlander wine of your choice per year, depending on your chosen membership;
- 10% discount on additional wine purchases;
- Always the first opportunity to choose from the new batch of Reestlander wines. Often these include wines that are only available in a limited edition;
- You will receive an exclusive invitation (2 people per Vine lease certificate) to the Spring Tasting (spring) and Tasting from the Barrel (winter);
- Free admission to the Wine Festival (summer);
- Free shipping in the Netherlands;
- As a member of our Wine Club, your name will be listed in our vineyard. A nice promotion for your business or just to visit your own vines;
- With a Silver and Gold Vine lease certificate, you will receive a complimentary wine tasting at the Wine Barn for 4 people including a Farmers Board;
- With a Golden Vines lease certificate, you will receive a free gift package with 2 bottles of Reestlander wine or 1 bottle of Reestlander Sprankling-Brut.
Picking out Reestlander wines You will receive wines from the year in which you conclude the Vine Lease Certificate. So if you conclude a certificate in 2021, you will be entitled to your wines in 2022. This is because the harvest normally takes place in October. The wines of the 2021 vintage will be bottled in spring 2022. If circumstances force us to deviate from this this will be discussed with you. The wines will be handed out during the Spring Tasting for which you will receive an invitation (by email). At that moment all wines are in stock and you have first choice in the wines. The Spring Tasting will be organized in the month of May or June. Of course, it is also possible to come and pick up the wines at another time. It is also possible to send the wines via the Digital Wine Cellar. You will receive a separate invitation to this by e-mail. The wines from which you have free choice are the standard wines made at the Reestlandhoeve. Occasionally there are wines made in a very limited edition or very exclusive wines. For these, an appropriate offer will be made. This may mean if you specifically choose this wine that you agree to fewer bottles of wine, for example. Please note: if you are not able to come to the Spring Tasting to make your wine choice at that time, you can come and pick up your wines at a later time when we are open. You will then have a one-time opportunity to taste the wines free of charge. You can make your choice from the wines currently in stock unless you have already made your choice in the Digital Wine Cellar. You can visit us during opening hours. As a member of our Wine Club, you can visit the vineyard and walk the wine trail with your guests free of charge during opening hours. However, the consumptions will be charged. Validity Vines lease certificate The Vines lease certificate is valid until December 31 after the year of closing or if the Reestlander wines are collected earlier. Benefits from the Vines lease certificate cannot be carried over to the following year. We will let you know up to 3 times that you can pick up your wine to which you are entitled. If after 3 times you do not respond which wine you wish to receive then after one year we will assume that you are not interested in the wines and the Vines Lease Certificate will be dissolved. After you pick up your wines, during the Spring Tasting or at any other time, your Vines lease certificate expires. Of course, you can continue your career as a wine grower(s) by renewing your Vines lease certificate. If you decide not to continue your career you will be removed from the database. You will then receive only the general newsletter for wine lovers but no more invitations to the events and special offers organized exclusively for the members of the Wine Club. Staying informed We will keep you regularly informed about the various activities of the Reestlandhoeve and the activities organized especially for you as a lease certificate holder by means of a digital newsletter. It is therefore important that we have a working e-mail address from you in order to keep you informed. It may happen that the newsletter ends up in SPAM. So it is important that you accept the email address; info@reestlandhoeve.nl. Helping out in the vineyard You are invited, as a vintner, Vine lease certificate holder, to help out in the vineyard. Special co-working days are scheduled for this purpose. We will keep you informed through the newsletter. Helping out in the vineyard is without obligation but it is a nice addition to your Vine lease certificate. Conditions Adopt a Vine With Adopt a Vine of the Reestlandhoeve you are the owner of 1 vine (or a multiple thereof) of the vineyard for a period of 5 years. For each vine you will receive 1 bottle of wine from the first harvest. After payment of Adopt a Vine, your registration is final and Adopt a Vine is valid. With the certificate you can identify yourself at the Reestlandhoeve and can use the various benefits for a period of 5 years. Should it happen that there is a bad harvest or a lesser harvest, this will be communicated to you and it may be possible that the Reestlandhoeve reserves the right to postpone the delivery. Eventually you will receive the number of bottles of wine for which you have signed the Adoption Certificate. Wijngoed de Reestlandhoeve does its utmost to make a good quality wine. However, the taste of the Reestlander wines may vary from year to year. This depends on the season and weather conditions. By adopting a vine, you adopt the good life: Benefits The adoption certificate offers you several benefits: – You receive the very first bottle of wine from a nature-inclusive vineyard. An exclusive first edition, think how that tastes. – You contribute to the restoration of a piece of primal Dutch nature that everyone enjoys. – You will receive regular updates, so you can follow exactly what your investment yields. – You will receive an invitation to the spring tastings at our vineyard, so you can experience up close how your vine flourishes in a biodiverse environment. – You make expansion of the vineyard possible, which provides more chores for our care farm. This keeps our clients actively involved in society Exclusive Reestlander wines You will receive the first wine from the newly planted vines. If we are forced by circumstances to deviate from this then this will be discussed with you. The wines will be awarded during the Spring Tasting for which you will receive an invitation (by e-mail). In the invitation you will also see in which year you are entitled to these bottles of Reestlander wine. The Spring Tasting will be organized in the month of May or June. Of course it is also possible to pick up the wines at another time or have them sent to you. Working in the vineyard As a winegrower you are invited to help out in the vineyard. Special days are planned for this purpose. We will keep you informed through the newsletter. Helping out in the vineyard is completely optional but a nice addition to your adoption plan. The discount card is valid only on the day of the reservation. The Reestlandhoeve reserves the right to change or cancel coupons at any time. The discount card can only be applied to bottles of Reestlander wine. Promotions are limited to one coupon per table. Offer good while supplies last. The Reestlandhoeve is not obligated to pay any taxes associated with the issuance or use of the discount card. Consumer is obligated to pay any applicable sales tax related to the use of the discount card. The discount card is invalid if restricted or prohibited by law.
